TECHNICAL REVIEW FEE SCHEDULE

 

The following fees will be charged by the Butler County Conservation District for technical reviews of Erosion and Sediment Pollution Control Plans, as authorized by Act 217 and the delegated agreement with the Department of Environmental Resources.

Only complete applications containing the required fee, the necessary number of plans and the location maps will be accepted for technical review.

Review fees shall apply to all plans that are submitted to the District requesting E&SPC plan adequacy, except as noted within. (Effective January 1, 2010)

EROSION & SEDIMENTATION POLLUTION CONTROL

PLAN REVIEW FEE SCHEDULE

 

APPLICABILITY OF FEE SCHEDULE

 

A.         The fee schedule shall apply to those plans that are submitted to the Butler County Conservation District requesting determination of adequacy for control of Erosion & Sediment Pollution.

 

B.         Each plan submission for a different project on the same tract of land will be charged according to the fee schedule (i.e. phased projects).

 

C.         In general, fees are intended to cover the initial review and one revision of a project, if submitted within 60 days of the deficiency letter.

**If plan revisions are not submitted within 60 days, a fee of 50% of the original fee will be charged.

** A charge of 30% of the original fee will be assessed for each additional review beyond the first revision.

 

D.         Revisions to the approved plans should follow the fee schedule. The fee should be based only on the portion of the plan being changed.

 

E.         Permit renewals should follow the fee schedule using the remaining disturbed area/units.

 

WAIVER OF FEES

 

A.          Fees will be waived for an application filed under the name of governmental sub-units of the United States, County Agencies, or Municipalities (School Districts, Universities, and local authorities are not exempt under this policy). Applications filed under the name of governmental sub-units of the Commonwealth of Pennsylvania will be as per Conservation District Law. This exemption does not apply to any private, non-profit organization or supersede Title 25, Chapter 102 Erosion Regulations. the Commonwealth of Pennsylvania

 

B.          The District reserves the right to waive fees on sites of very minimal earth disturbance considered on a case-by-case basis.

 

ADMINISTRATIVE PROCEDURES

 

A.          For non-permitted projects, the applicant shall submit the review fee made payable to the "Butler County Conservation District", a complete set of plans and an application.

 

B.          The Butler County Conservation District will accept the application when all of the necessary information and fees are supplied. Plans and plan revisions will be reviewed in the order in which they are received. Maximum review time will be thirty (30) working days.

 

C.          The Pennsylvania Department of Environmental Resources National Pollutant Discharge Elimination Systems (NPDES) Permit Application will be administered under the Bureau of Land and Water Conservation administrative guidelines. The permit fee required for the NPDES Permit should be separate from the Butler County Conservation District review fee and should be made payable to the "Butler County Clean Water Fund."

 

D.          The Butler County Conservation District reviews an Erosion and Sediment Control plan solely to determine whether it is adequate to satisfy the requirements of Title 25, PA Code Section 102 et. seq., the Erosion Control Regulations of the Department of Environmental Resources. By a determination that the plan is adequate to meet these requirements, neither the Conservation District nor the County assumes any responsibility for the implementation of the plan or the proper construction and operation of the facilities contained in the plan.

 

E.          Letters indicating adequacy of Erosion and Sediment Pollution Control plans are valid for three (3) years after issuance. Should project construction fail to commence before three years has elapsed, a resubmission of the plan is required.
